® RESOLUTION NO. 88 - <br />WHEREAS, the Board of County Commissioners of Indian <br />River County on September 27, 1988, at 9:05 A.M. conducted <br />an equalization board hearing with regard to the above <br />described improvements; and <br />WHEREAS, in accordance with §11.47, Indian River County <br />Code, this resolution confirms the amount of the special <br />assessments to be"made against the property owners to be <br />benefited by the improvement program hereinabove described, <br />which assessments shall stand and remain legal, valid, and <br />binding first liens upon the property against which such <br />assessments are made, until paid; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, as follows: <br />1. The proposed assessment roll adopted by the County <br />by Resolution No. 88-49 is hereby confirmed, approved,. and <br />shall remain legal, valid, and binding liens against the <br />property assessed until paid. <br />2. That the said assessments herein provided for shall <br />be due and payable in full within 90.days after actual costs <br />are established by the "as built" resolution without any <br />payment of interest. If not paid in full, this assessment <br />maybe paid in five equal yearly installments, plus accrued <br />Interest, to .which,' If not paid when due, there sha I I be a <br />penalty at the rate of 11% of the unpaid principal. The <br />unpaid balance of the assessment shall bear interest at the <br />rate of 12% per, annum from the date of completion and <br />acceptance until paid. <br />3. That the Clerk is hereby directed to record this <br />resolution along with a list of the affected land owners <br />shown on the attached assessment roll on the public records, <br />which shall constitute prima facie evidence of validity. <br />14a <br />I.
