Attorney Vitunac believed that this law is not very well <br />written and confirmed that it has never been repealed or amended. <br />It says something that really should be taken care of, but he <br />didn't believe that is a problem of the County. The County has <br />the right to waive its restriction on the deed to the State, and <br />then it is up to the State to live up to the law or not. If the <br />State lawyers find that this paragraph in the law is a problem, <br />they have the power to go to the Legislature and get this Special <br />Act repealed, or they can go ahead and charge fees and let <br />someone try to enforce this provision. If the DNR was a <br />proponent of getting rid of this special act, they could do it <br />very easily, but it cannot involve the County in any problem. <br />The County is safe, regardless of this act. <br />Mr. Lewis advised that the former and present general <br />counsels for the DNR have reviewed this matter and feel that a <br />fee would not be prohibited under this Special Act. They feel <br />this act really addresses the long-term protection, maintenance, <br />and the fact that the park is open 24 hours a day, and that there <br />is no need to repeal this Special Act in order to charge a fee. <br />Attorney Vitunac pretty much agreed with that, but stressed <br />that it is still a State problem and won't involve the County in <br />any lawsuits. <br />Commissioner Bird wondered how much it would have cost <br />the County to duplicate the improvements the State has made there <br />in the last 18 years and how large a staff it would have taken to <br />operate the south side with those facilities put there by the <br />State. He felt sometime ago that a possible compromise on the <br />south side would be to charge an admission fee to the western <br />portion where the boat ramp is and the camp grounds, but leave <br />the jetties and the major portion of the inlet that is used by <br />fishermen open for public fishing. <br />Mr. Lewis felt it would take them a good while to go back <br />over the years and compile a list of the costs of the improve- <br />ments made there in the last 18 years. <br />25 <br />OCT 11 7988 <br />POCK 74 469 <br />
