ABERNETHY <br />`FRANCHISE MANAGER <br />VILLAGE GREEN WATER & WASTEWATER FRANCHISE VIOLATIONS <br />POSTPONED FROM THE BOARD MEETING OF MAY 31, 1988 <br />BACKGROUND <br />In May, 1988 the water plant at the Village Green Mobile Home Park <br />failed to perform and deliver quality water to the residents. Upon <br />staff's evaluation of the water plant the owner and the County <br />entered into an Agreement specifically requiring the Owner to state <br />within a 120 day period their intentions of rectifying the <br />violations of the Village Green Water and Wastewater Franchise <br />(Utility). The Agreement imposes upon the Utility, over and beyond <br />the County Utility rates, a surcharge of 50% effective at the end of <br />the 120 day period. Further, the Commission issued an <br />administrative order -confirming the terms of the Agreement and <br />requiring the owner to at the end of 120 days make either a <br />permanent connection to County facilities, paying all associated <br />fees, or to make arrangements for the construction of a new water <br />treatment plant meeting all State and County specifications and <br />standards. <br />ANALYSIS <br />Staff has contacted the Owner from time to time informing the Owner <br />of the remaining time per the Agreement. On September 23, 1988, <br />staff received formal notice from the Owner stating the decision to <br />provide a fresh water supply to the park with their own reverse <br />osmosis plant (RO). The Owner states in the notice an anticipated <br />four week period to rebuild the existing plant and an additional <br />anticipated eight weeks to provide a new RO plant. Staff has <br />responded to the formal notice of September 23rd and requests the <br />Owner to submit formal specifications for the County's review and <br />approval. Staff anticipates the Owner to comply with the request <br />within two to three weeks. Staff feels the current provision for <br />the park to receive water via a temporary connection to County <br />Utilities may remain in force until the County determines that the <br />Owner has exhausted all avenues to provide an adequate facility for <br />the park as outlined in the Agreement. <br />RECOMMENDATION <br />Staff requests the Board of County Commissioners toapprove the <br />continuation of the 50% surcharge until such time as the Owner <br />complies with State and County specifications and standards for a <br />new facility or connection into County Utilities. Staff requests <br />and recommends the Board to authorize the Chairman to sign the <br />foregoing Resolution outlining the Owner's requirements for the <br />construction of a new facility. <br />17 <br />OCT 18 1988 <br />Dor 74 F uE. 537 <br />
