STAFFING OF SOLID WASTE DISPOSAL DISTRICT <br />County Attorney Vitunac reviewed the following, noting that <br />a question was raised regarding the fact that the Board never has <br />officially determined who the staff will be for the SWDD. This <br />memo lays out the-Board's'prerogatives: <br />TO: Board of County Commissioners <br />r)/U <br />FROM: Charles P. Vitunac, County.Attorney <br />DATE: November 7, 1988 <br />RE: STAFFING OF SOLID WASTE DISPOSAL DISTRICT (SWDD) <br />At the November 1, 1988, Board of County Commissioners' <br />Meeting, several commissioners asked questions concerning <br />the organizational chart of the SWDD and, in particular, <br />asked whether the employees of the District reported through <br />the County Administrator. I indicated that that was a <br />decision which had to be made by the Board of Commissioners <br />of the Solid Waste Disposal District. <br />The County created the SWDD by ordinance approved by the <br />five municipalities in Indian River County, pursuant to <br />§125.01(5)(a), Florida Statutes. Concerning the <br />organization of the District, the County ordinance reads as <br />follows: <br />"Section 4, Powers of SWDD. The SWDD shall have all <br />powers necessary and incident to accomplishing the <br />purpose of the District, which power shall include the <br />power to hire, fire, and set compensation of <br />employees..." <br />It is legally possible for the District to hire its own <br />staff independent of the County's staff. Likewise it is <br />permissible for the District to contract with the County <br />to use County staff to perform the functions of the <br />District. The District may hire a SWDD Administrator to <br />report directly to the SWDD Commissioners or it may <br />authorize the County Administrator to perform that function. <br />If the County staff is used, the County must be reimbursed <br />by some formula which ensures that revenue and charges are <br />kept separate vis-a-vis the County -District distinction. <br />Presently a General and Administrative Charge of 11.51% of <br />gross salaries has been budgeted in the 1988/89 fiscal year. <br />The Board can make its decision concerning how to organize <br />the District by motion at any regular meeting of the SWDD <br />and the BCC. <br />NOV 151988 <br />40 <br />Poor 75 F'AEE184 <br />
