Loeper AWL <br />REFERENCES: INITIATED REQUEST <br />TO REZONE 10.5 ACRES FROM <br />CL TO OCR AT THE ENTRANCE <br />TO VISTA ROYALE GARDENS <br />Staff Planner <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of December 6, 1988. <br />DESCRIPTION & CONDITIONS <br />This is a county initiated request to rezone 10.5 acres of land <br />from CL, Limited Commercial District to OCR, Office, Commercial, <br />and Residential District. The subject parcel is situated at the <br />entrance of the Vista Royale Gardens condominium complex on U.S. <br />1; the location is south of Indian River Boulevard, and north of <br />the south relief canal. The subject parcel is a portion of a <br />larger 17.9 acre tract. <br />° Chronology of Past Actions <br />This request was initiated by staff at the direction of the Board <br />of County Commissioners. The Board's directions were the result <br />of a considerable number of controversial land use reviews <br />involving the overall 17.9 acres, of which this parcel is a part. <br />The following is a brief chronology of recent activities relating <br />to the subject parcel. - <br />1) July 1987 - Site plan approval request for a shopping <br />center, including an administrative permit approval <br />request for a department store, submitted for 17.9 acre <br />parcel. <br />2) January 1988 - Residents of Vista Royale Gardens and <br />Vista Royale approach Board of County Commissioners <br />concerning commercial development of site. Board <br />directs staff to initiate comprehensive plan <br />amendment/rezoning for 17.9 acre parcel from <br />Commercial/CL to MD-2/RM-10. <br />3) March 1988 - Planning and Zoning Commission denies site <br />plan and comprehensive plan amendment/rezoning <br />requests. <br />4) Applicant appeals site plan denial; staff appeals land <br />use change denial. <br />5) April 1988 - Board of County Commissioners denies site <br />plan appeal, citing traffic and safety concerns as <br />reason for denial. <br />6) April 1988 - Board of County Commissioners approves <br />transmittal of land use change request to Department of <br />Community Affairs for mandatory review. <br />17 <br />DEC 6188 <br />EkDOK `ib mE.zOL) <br />
