At the P&Z <br />meeting Mr. Brandenburg twice made references about this Board <br />and questioned their motivations, speculating that the <br />county -initiated rezoning was an attempt by the Board to punish <br />the developer for presenting a site plan they didn't like. <br />Later he questioned whether staff's recommendation was an attempt <br />to appease the Board. Attorney Barkett continued that today <br />Attorney Brandenburg also questioned his integrity in repre- <br />senting Vista when he earlier had written an agreement regarding <br />the access road. Attorney Barkett stated that he personally had <br />no problem with his writing that agreement and doubted any other <br />lawyer present did, and he did not think those kind of <br />representations have a place in this except they do show the <br />extent to which this developer is prepared to go to get what he <br />wants with regard to this property. <br />Attorney Barkett continued that in regard to the tests for <br />justifying a rezoning, there obviously have been many changes in <br />this area - Indian River Boulevard has opened; traffic has <br />increased tremendously while U.S.I. has remained unimproved, and <br />the development on U.S.I. has been dramatic. <br />Chairman Scurlock pointed out that the Comprehensive Land <br />Use Plan is designed to be updated, and we accordingly are <br />required'to analyze our capital improvement programs and their <br />cost effectiveness. As all of these factors change, he believed <br />we are mandated to look at zoning as a part of this. We did have <br />concerns about the traffic increase, and he takes a little bit of <br />offense at the intimation that the Commission is doing this re- <br />zoning with some concealed purpose.
