McCoy d,191v <br />Staff Planner, Current Development <br />DATE: January 27, 1989 <br />SUBJECT: TASHKEDE PROPERTIES REQUEST FOR RIGHT-OF-WAY ABANDONMENT <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of February 7, 1989. <br />DESCRIPTION AND CONDITIONS: <br />Steve Henderson, Esq., on behalf of Tashkede Properties, Ltd., has <br />submitted a petition for abandonment of a portion of the canal and <br />road rights-of-way as shown on a plat of the Fellsmere Farms <br />Company Subdivision. The applicant's agent has stated that the <br />County has little legal interest in these rights-of-way (the plat <br />does not specifically dedicate road right-of-way to the County). <br />The purpose of this abandonment is to have the County release what <br />interest it may have to "clear title" for the surrounding, <br />assembled property. <br />These rights-of-way have provided drainage ways for agricultural <br />operations. The present owner wants to have the rights-of-way <br />abandoned in order to establish an agricultural operation which <br />uses a new design, which could not otherwise be accommodated with <br />the existing platted drainage/roadway grid layout. <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all County divisions and utility <br />providers having jurisdiction or potential interests within the <br />right-of-way. All reviewing agencies and departments have <br />recommended approval of the abandonment. These right-of-ways are <br />not part of the roadway system as noted on the County Thoroughfare <br />Plan, and are not needed for the thoroughfare system. The County <br />Attorney's office has reviewed and approved the attached abandon- <br />ment regulation for legal form and sufficiency. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to the right- <br />of-way as described in the resolution and that the Chairman of the <br />Board of County Commissioners be authorized to execute the at- <br />tached resolution (Attachment #3). <br />22 <br />
