McCoy/%P% <br />Staff Planner, Current Development <br />0 <br />DATE: January 6, 1989 <br />SUBJECT: MARVIN HALL'S REQUEST FOR THE ABANDONMENT OF 79TH COURT <br />BETWEEN 134TH STREET AND 135TH STREET IN ROSELAND <br />It is requested that the data herein presented be given formal <br />consideration by the Planning and Zoning Commission at its <br />regular meeting of February 7, 1989. <br />LOCATION AND DESCRIPTION: <br />Marvin Hall has submitted a petition for abandonment of 79th Court <br />between 134th Street and 135th Street. Currently, this <br />right-of-way property is wooded. The petitioner proposed to use <br />the abandoned right-of-way property to enhance the use of his <br />adjacent property. <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all County divisions and utility <br />providers having jurisdiction within the right-of-way. All <br />reviewing agencies and departments have recommended approval of <br />the abandonment, with the provision that a 40' drainage and <br />utilities easement be retained. <br />This portion of 79th Court is not part of the roadway system as <br />noted on the County Thoroughfare Plan, and is not needed for the <br />thoroughfare system. Abandonment of the subject right-of-way <br />would not deny convenient access to any adjacent property. The <br />County Attorneys office has reviewed and approved the attached <br />resolution for legal form and sufficiency. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to that <br />portion of 79th Court described in the attached resolution, and <br />that the Chairman of the Board of County Commissioners be <br />authorized to execute the attached resolution (Attachment #3), <br />with the following condition: <br />1. A 40' drainage and utilities easement be retained as <br />described in Exhibit "A". <br />The Chairman asked if anyone wished to be heard. There were <br />none, and he thereupon declared the public hearing closed. <br />ON MOTION by Comissioner Bowman, SECONDED by Com- <br />missioner Scurlock, the Board unanimously adopted <br />29 <br />FEL 7 1989 <br />lkOOK 76 F' GL 29 <br />
