REGULATIONS FOR <br />SPECIFIC LAND USES, AND SECTIONS 5(A), 6, 10(A), AND 11(A) <br />RESIDENTIAL DISTRICTS OF APPENDIX A OF THE CODE OF LAWS AND <br />ORDINANCES OF INDIAN RIVER COUNTY, FLORIDA, KNOWN AS THE <br />ZONING CODE, PROVIDING FOR PUBLIC/PRIVATE DOCKS IN <br />RESIDENTIAL ZONING DISTRICTS AND DEFINING SAME; PROVIDING <br />FOR SPECIFIC CRITERIA FOR ESTABLISHING SUCH USE; AND <br />PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; <br />CODIFICATION; SEVERABILITY; AND EFFECTIVE DATE. <br />NOW THEREFORE, BE IT ORDAINED by the Board of County <br />Commissioners of Indian River County, Florida, that: <br />SECTION 1 <br />Section 2 (b) of the language and definitions of Appendix A, <br />Zoning, of Indian River County Code of Laws and Ordinances is <br />hereby amended as follows: <br />Dock, Public/Private. A fixed or floating structure, <br />including moorings, used for the purpose of berthing buoyant <br />vessels, which structure does not provide fueling, or other <br />commercial services normally associated with a marina, <br />except that berthing slips may be rented or leased to the <br />general public. <br />SECTION 2 <br />Section 25.1 (o) of Appendix A, the Zoning Code, Indian <br />River County Code of Laws and Ordinances is hereby amended to <br />read as follows: <br />(7) Public/Private Docks (Special Exception) <br />a. Districts requiring special exception: <br />Public/Private Docks may be allowed in the RS -1, <br />RS -3, RS -6, RM -3, RM -4, RM -6, and RM -8 Districts <br />upon receiving approval for a special exception as <br />provided in Section 25.3 and after meeting the <br />requirements defined below. <br />b. Additional information requirements: <br />1. A site plan showing the location, dimensions <br />and area of dock facility and meeting all <br />requirements of Section 23. <br />c. Criteria for Public/Private Docks: <br />1.
