DESCRIPTION AND CONDITIONS <br />DENNIS L. SMITH, INC., on behalf of JOHN R. AND BARBARA S. <br />TRIPSON, has submitted a request to receive special exception <br />approval for a sand mining operation ("Phase II") located in the <br />RS -3, Residential Zoning District. Because a portion of the <br />property is residentially zoned, special exception use approval is <br />required. The proposed mine is located on the south side of 17th <br />Street S.W., approximately 1400' west of 27th Avenue. <br />The applicant received approval for Phase I of the mining opera- <br />tion (located entirely with in the A-1 zoning district) at the <br />December 15, 1988 Planning and Zoning Commission meeting. The <br />applicant is now seeking approval for Phase II, the portion that <br />includes RS -3 property that is covered by the special exception <br />use. <br />The Planning and Zoning Commission voted 4 to 1 to recommend <br />approval and directed staff to try and get more definite informa- <br />tion on noise levels for the Board of County Commissioners. <br />Special exception uses are those types of uses that would not <br />generally be appropriate throughout a particular zoning district. <br />However, when special exception uses are carefully controlled as <br />to number, area, location, and/or relationship to the vicinity, <br />such uses would not adversely impact the public health, safety, <br />comfort, good order, appearance, convenience, and general welfare <br />and, as such, would be compatible with permitted uses within the <br />particular zoning district. Special exceptions require submittal <br />of an approvable site plan meeting all site plan criteria, zoning <br />district criteria and the criteria set forth in the regulations <br />for the specific land uses. <br />The Board may attach any conditions and safeguards necessary to <br />ensure compatibility of the use with the surrounding area. <br />ANALYSIS: <br />1. Project Size: Phase I: 39.81 acres <br />Phase I and Phase II: 47.46 acres <br />2. Area to be Excavated: Phase I: 12.6 acres <br />Phase I and Phase II: 16.1 acres <br />3. Zoning Classification: Phase I: A-1 <br />Phase I and Phase II: RS -3 & A-1 <br />4. Land Use Designation: Phase I: LD -I <br />Phase I and Phase II: LD -1 <br />5. Estimated excavated Volume: Phase I: 610,919 cubic yards <br />Phase I and Phase II: 822,431 cubic yards <br />6. Setbacks: Phase II: 150' from property lines <br />7. Depth of Mine: Phase II: 50' below natural grade (-29.0 <br />N.G.V.D.) <br />8. Ground Water Table: In both phases the water table varies <br />from one to four feet below natural grade. The agent has <br />provided a sealed statement from a registered engineer <br />stating this operation will have no adverse effect on ground <br />water quality or quantity. <br />9. Method of Mining (Both Phases): The overburden will be <br />removed down to the water table by conventional dry mining <br />equipment, (i.e. backhoes, bulldozers, and trucks). <br />41 <br />FEB 2 8 1989 <br />BOOK 76 FACE 261 <br />
