MEI <br />trict, shall not be limited to specific hours of operation <br />unless a determination is made by the Planning and Zoning <br />Commission concerning the need of limiting hours of operation <br />due to the anticipated impact of the mining operation on <br />surrounding properties. Applicants operating in residential <br />zoning districts (as in the proposed Phase II) shall be <br />permitted to operate between the hours of 7:00 a.m. to 5:00 <br />p.m. on weekdays; operation on Saturday and Sunday and/or <br />operation other than 7:00 a.m. to 5:00 p.m. may be permitted <br />by the Board of County Commissioners if the impact of the <br />mining operation on surrounding properties will not consti- <br />tute a nuisance to the neighborhood. <br />2. A site plan meeting all requirements of Sections 23.1 and <br />23.2 of the County Zoning Code. <br />3. A reclamation plan including littoral zone plan and water <br />quality management plan, as applicable. <br />4. All mining activities must comply with Section 25(r), Excava- <br />tion and Fill, Appendix A, Zoning, of the County Code. <br />5. All mining sites shall have direct access to a.collector or <br />arterial roadway; access from a roadway of lesser functional <br />classification may be approved by the Public Works Director <br />upon a finding that no significant adverse impactwill affect <br />residential units on the subject road. <br />6. The site must not be located within one thousand (1,000) feet <br />of any platted subdivision that is not serviced by public <br />water. <br />Regarding criterion #1, the applicant is requesting 24 hour <br />operation of the mining project. Staff believes extended hours <br />could be permitted, if the applicant takes steps to ensure that <br />the mining operation will not produce noise great enough to <br />constitute a nuisance to the surrounding property owners (i.e. <br />does not trigger complaints from people who live in the area). <br />Other than this request, the application meets all applicable <br />criteria. <br />RECOMMENDATION: <br />Based on the analysis performed, staff• recommends that Board of <br />County Commissioners approve the special exception use with the <br />following conditions: <br />1. That prior to site plan release: <br />a. The applicant shall post the necessary funds for the <br />restoration and compliance bonds, these bonds shall not <br />expire until the County has approved the reclamation of <br />the mine. <br />b. The applicant shall submit details of the 27th Avenue <br />apron design that are acceptable to the County Engineer. <br />2. That prior to the issuance of a mining permit: <br />a. The paved apron shall be installed along 27th Avenue as <br />approved by the County Engineer. <br />b. The sight distances along 27th Avenue shall be improved <br />to 750' north and south of the access driveway on 27th <br />Avenue. <br />c. The proper signage shall be placed to alert motorists <br />that trucks will be entering the highway. <br />3. During the operation of the mine, the applicant shall take <br />all reasonable steps to minimize noise generated at the site. <br />4. A mining permit shall be issued conditionally for extended <br />hours (no restriction on hours of operation); however, if <br />valid complaints are received and verified in regard to noise <br />generated outside of normally set operating hours, then the <br />County can restrict the mine's operation to the normal <br />operating hours set forth by the ordinance (7:00 a.m. to 5:00 <br />p.m. Monday thru Friday). <br />43 <br />FEB 28 '1989 <br />BOOK 76 GL.263 <br />
