RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners determine <br />that the Grand Harbor, Inc . ' s request to add a ±4 acre parcel to <br />the overall Grand Harbor project area for use as a golf mainte- <br />nance facility does not constitute a substantial deviation (as <br />defined in Florida Statutes Chapter 380.06) and shall be reviewed <br />and adopted as a minor amendment. <br />Stan Boling, Chief of Current Development, explained that it <br />is the opinion of the Treasure Coast Regional Planning Council <br />and the Dept. of Community Affairs that this is not something <br />that would require regional review, and staff concurs. However, <br />Assistant County Attorney Bill Collins has advised that according <br />to State Statutes, the developers should be given an opportunity <br />to convince the Board that the change is not substantial enough <br />to require regional review. <br />Chairman Wheeler opened the Public Hearing, and asked if <br />anyone wished to be heard in this matter. <br />Darrell McQueen, engineer representing Grand Harbor, advised <br />that State Statutes stipulate that any addition of Land requires <br />the developer to show that there is not a substantial deviation, <br />and he believed that they have shown successfully to the <br />T.C.R.P.C. and the DCA that this is not a substantial deviation. <br />Part of the basis for that was that the 4 acres of land mass that <br />they are adding to this development is to replace a use that they <br />had there previously. Alt the golf maintenance will be put on <br />this site. The 1.7 and 2.5 -acre tracts are being left as open <br />recreation space. The drainage was considered previously in the <br />Grand Harbor plan for off-site areas, and there should be no <br />trouble with the drainage. Mr. McQueen stated that this addition <br />does not meet any of the threshold listed in the Statutes for a <br />substantial deviation. <br />There being no others who wished to be heard, Chairman <br />Wheeler closed the Public Hearing. <br />47 <br />FEB 28198 <br />
