McCoy (/' <br />Staff Planner, Current Development <br />DATE: February 7, 1989 <br />SUBJECT: ERNEST & DAISY TERRY'S REQUEST TO ABANDON A PORTION OF <br />68TH PLACE <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of March 7, 1989. <br />DESCRIPTION AND CONDITIONS: <br />Ernest and Daisy Terry have submitted a petition for the <br />abandonment of that portion of 68th Place (Palm Avenue) which <br />borders lots 4, 5, 6, Block 3 and lots 17, 18, 19, Block 2 of the <br />Quay Subdivision. This portion of right-of-way is located between <br />U.S. #1 and Old Dixie Highway, but does not provide access through <br />to U.S. #1 (the area east of the subject right-of-way was <br />originally part of the Quay Subdivision, but has since been <br />vacated) . <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all County divisions and utility <br />providers having jurisdiction within the right-of-way. All <br />reviewing agencies have recommended approval of the abandonment, <br />with the provision that a 12' utilities and drainage easement be <br />retained. The 12' easement will be over the north 12' of the <br />subject right-of-way. This portion of 68th Place is not part of <br />the roadway system as noted on the County Thoroughfare Plan, and <br />is not needed for the thoroughfare system. <br />This portion of 68th Place is unpaved and is currently used for <br />access to the lots which have frontage. These lots are owned by <br />the applicant, who has obtained a rezoning on these properties <br />from RM -6 to OCR. The applicant has filed a unity of title form, <br />which will ensure a unified development of these properties. The <br />County Attorney's office has confirmed that the Unity of Title <br />(see attachment #4) is sufficient to ensure that all lots adjacent. <br />to the subject right-of-way are now one parcel that cannot be <br />re -divided without County approval. Thus, approval of the <br />abandonment would not deny convenient access to this unified <br />parcel: access would still be available where 68th Place would <br />"dead-end" into the parcel. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to this <br />portion of 68th Place, and that the Chairman of the Board of <br />County Commissioners be authorized to execute theattached <br />resolution (Attachment #3) with the following condition: <br />1.
