IVi AR 'd 1989 <br />BOOK76 1'A E J21 <br />DESCRIPTION AND CONDITIONS: <br />Robin and Jeffery Pauley in conjunction with Jim Sabonjohn have <br />submitted a petition for the abandonment of 85th Avenue south of <br />22nd Street. <br />Per guidelines established by the Board of County Commissioners, <br />the petition was reviewed by all County divisions and utility <br />providers having jurisdiction within the right-of-way. All <br />reviewing agencies have recommended approval of the abandonment, <br />with the provision that the entire right-of-way be retained as a <br />drainage and utilities easement. While the County is retaining <br />the entire portion of the subject right-of-way as an easement, the <br />property owners will benefit by being able to build in the old <br />setbacks and use the easement (abandon right-of-way) for setback <br />purposes. <br />This portion <br />noted on the <br />thoroughfare <br />stubs -out to <br />has frontage <br />any property <br />of 85th Avenue is not part of the roadway system as <br />County Thoroughfare Plan, and is not needed for the <br />system. The right-of-way is currently wooded and <br />a large tract of multi -family zoned property, which <br />on S.R. 60. The abandonment will not deny access to <br />owner. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to 85th Avenue <br />and that the Chairman of the Board of County Commissioners be <br />authorized to execute the attached resolution (Attachment #3), <br />with the condition: <br />1. that drainage and utilities easements be retained over the <br />entire subject right-of-way. <br />The Chairman asked if anyone present wished to be heard. <br />There were none, and he thereupon declared the public hearing <br />closed. <br />ON MOTION by Commissioner Bird, SECONDED by Com- <br />missioner Bowman, the Board unanimously (4-0) <br />approved Resolution 89-27 providing for the <br />abandonment of a portion of 85th Avenue as re- <br />quested by Robyn Pauley. <br />22 <br />
