Attorney O'Haire emphasized that this is not going to be a <br />large project; it is going to be a small boat ramp and everything <br />east of the boat ramp is going to be committed to conservatism. <br />Mitigation will be through restoration of pepper groves between <br />the impoundment dike and the project and also by making <br />functional marsh lands out of them for a net increase of more <br />than 2 acres. <br />Attorney O'Haire advised that all of these conditions are <br />acceptable to the developer, but if maintenance is a concern, he <br />suggested that the Commission go on record right now to make it <br />abundantly clear that the County is not accepting responsibility <br />for maintenance of the canal. He stated that they would have no <br />problem with that whatsoever. Dean Luethje, project engineer <br />from Carter & Associates, has been meeting with the different <br />agencies relative to the whole project and is here today to <br />answer any questions. <br />Commissioner Scurlock was more interested in being positive <br />in terms of stating whose responsibility it is, because he felt <br />it would be clearer and easier to do and it would be to the best <br />interests of the project to make sure that the canal is <br />maintained in a navigable way. <br />Attorney O'Haire didn't have a real problem with that, but <br />was tempted to suggest that perhaps the maintenance <br />responsibilities should be allocated according to the number of <br />docks allowed along the waterway. <br />Commissioner Bowman pointed out that back in December, 1982, <br />the Board of County Commissioners voted to adopt Ordinance 82-30, <br />which rezoned the subject property to R -2D, with the exception of <br />200 feet on the north boundary, which was rezoned to R -1A and <br />subject to all R -1A requirements. This 200 feet was to provide a <br />buffer to River Shores, a single-family residential development. <br />Reading aloud from the Minutes of the BCC Meeting of December 1, <br />1982, she quoted the following statement by Attorney O'Haire: <br />"Attorney O'Haire informed the Board that they will accept the <br />17 <br />;MAR 1989 <br />eooK 76 FACE 457 <br />
