AR 2 `989 <br />die e <br />ROOK F E. 47O <br />is not a condition that was imposed by the Treasure Coast <br />Regional Planning Council. All substantial deviation does is <br />force a developer back to more reviews. <br />Attorney Henderson did not know what what else to say except <br />that once committed, and once construction begins, this is the <br />kind of project that is likely to proceed to a successful <br />conclusion. He asked the Board not to overlook the fact that <br />there are 2 deadlines here that must be met. The shell must be <br />constructed within 24 months, or December 3, 1995, and that is a <br />multi-million dollar commitment on the part of the developer. <br />The foundation itself is a major investment. Attorney Henderson <br />just didn't feel that the danger perceived by the Board is all <br />that likely due to the fact that construction financing once <br />committed is not likely to be cut off in the middle of a project. <br />Commissioner Bird understood then that they would not start <br />until they got the anchors and substance that they need, and <br />Attorney Henderson said that was correct. <br />Commissioner Scurlock was satisfied with the hammers <br />provided in Items #2 and #3, and preferred to address <br />"substantial construction" through the site plan requirements. <br />Vice Chairman Eggert opened the Public Hearing, and asked if <br />anyone wished to be heard in this matter. There being none, she <br />closed the Public Hearing. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bird, the Board unanimously (4-0, Chairman <br />Wheeler being absent) adopted Resolution 89-31A, <br />establishing the Development Order approving the <br />revised Harbor Town Center Development of Regional <br />Impact, subject to the conditions as set out in staff's <br />recommendation and with the addition of Paragraph 9 on <br />Page 24 of the Development Order. <br />RESOLUTION 89-31A WILL BE PLACED ON FILE IN THE OFFICE OF THE 7,;1% <br />CLERK TO THE BOARD WHEN FULLY EXECUTED AND RECEIVED /W.4q <br />30 <br />
