Pr" <br />APR 41999 <br />800K 76 FACE 488 <br />6. a contract for construction of remaining required sidewalk <br />improvements; and <br />7. a letter of credit guaranteeing the contract for construction <br />of remaining required sidewalk improvements. • <br />ANALYSIS: <br />1. Utilities: The Environmental Health director has approved <br />the use of individual septic systems for the proposed lots, <br />and water service will be provided by Indian River County. <br />2. Public Works: The county Public Works and Utilities Depart- <br />ments have verified that all required improvements have been <br />constructed in accordance with the approved County Land <br />Development Permits and that the warranty maintenance <br />agreement is satisfactory. <br />Section 10(E)3 of the County Subdivision Ordinance gives the <br />Board of County Commissioners "the discretion to grant the <br />applicant a two-year period, after final inspection of <br />subdivision improvements, to construct sidewalks if the <br />applicant posts construction security in the amount of one <br />hundred and fifteen (115%) percent of the construction <br />costs". The Public Works Department has verified that the <br />submitted cost estimate for the future installation of <br />required sidewalks is sufficient. <br />3. County Attorney:- The County Attorney's office has reviewed <br />and approved the submitted warranty maintenance agreement and <br />supporting letter of credit, as well as the contract for <br />construction of remaining required sidewalk improvements and <br />supporting letter of credit. <br />All applicable requirements regarding final plat approval have <br />been satisfied. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant <br />final plat approval to the Hidden Oaks Subdivision; accept the <br />submitted warranty maintenance agreement and letter of credit, and <br />the contract for construction letter of credit; and authorize the <br />Chairman of the Board to execute the submitted contract for <br />construction of required improvements. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Bowman, the Board unanimously granted <br />Final Plat Approval to Hidden Oaks Subdivision; <br />accepted the warranty maintenance agreement and <br />letter of credit; and authorized the Chairman to <br />execute the contract for construction of required <br />improvements. <br />COPIES OF ABOVE DOCUMENTS ON FILE IN THE OFFICE OF CLERK TO THE <br />BOARD. <br />4 <br />
