Collins <br />County Attorney <br />James Davis, P.E. <br />Public Works Director' <br />DATE: April 14, 1989 <br />SUBJECT: FLOOD INSURANCE AMENDMENTS TO THE STORMWATER <br />MANAGEMENT ORDINANCE <br />It is recommended that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of May 2, 1989. <br />DESCRIPTION & CONDITIONS <br />Recently, the Federal Emergency Management Agency (FEMA) complet- <br />ed a reevaluation of flood hazards for Indian River County. The - <br />Flood Insurance Rate Map (FIRM) resulting from this study was <br />presented to the county last summer, and since that time the FIRM <br />has been reviewed and has undergone a mandatory ninety day appeal <br />period. Since no appeals were filed to the FIRM, it will become <br />effective on May 4, 1989. <br />FEMA requirements mandate that the county, in conjunction with <br />adoption of the new maps, update its flood regulations to incor- <br />porate new FEMA requirements. Because the county's flood regula- <br />tions are part of the stormwater management ordinance, it is <br />necessary to amend that section of the code. The proposed <br />amendments are attached to this agenda item. <br />ALTERNATIVES & ANALYSIS <br />To maintain its eligibility for the National Flood Insurance <br />Program, the county must adopt the applicable FEMA regulations. <br />Essentially, the county's only other alternative is to adopt <br />regulations which exceed FEMA's requirements. Failure to adopt <br />such regulations will result in"the county's termination from the <br />flood insurance program. <br />As presently structured, the stormwater management ordinance <br />meets most of FEMA's requirements. The proposed amendments <br />attached to this item incorporate the new FEMA requirements into <br />the stormwater management ordinance. Adoption of these amend- <br />ments will ensure continued eligibility of the county in the <br />National Flood Insurance Program (NFIP). <br />One minor problem has arisen in scheduling the public hearing for <br />the proposed amendment. Because of Confederate Memorial Day, a <br />recognized legal holiday in Florida, the legal notice was adver- <br />tised one day less than required for a regular public hearing. <br />To resolve this problem and still take action within the neces- <br />sary - timeframe, it will be necessary for the Board of County <br />Commissioners to adopt the proposed amendments as an emergency <br />ordinance. To do so, the board must waive the notice require- <br />ments by a four-fifths vote, declare that an emergency exists, <br />MAY 1989 27 �coK �� F,�uL 754 <br />
