ANALYSIS: <br />In lieu of dedicating an improved access easement from S.R. A.I.A. <br />to the river, the owners have agreed to dedicate to the County's <br />Park Development Fund $8,200 at the time of the final plat ap- <br />proval. The $8,200 amount is based on an Armfield-Wagner ap- <br />praisal (see attachment #3) of the fair market value of the <br />required 15' wide improved access easement. The Property Apprais- <br />er's office and the County's Right -of -Way Agent have verified <br />(see attachment #4) that the appraisal is a reasonable estimate of <br />the raw land value of the required easement and the Public Works <br />Department has verified that the cost estimate for an improved <br />pedestrian walkway is reasonable. <br />Dedication of the appraisal value is adequate for satisfying the <br />public access requirement of Section 10(r) of the subdivision <br />ordinance, if accepted by the Board of County Commissioners. If <br />the lawsuit outcome is known prior to final plat approval for this <br />project, then the County will address all active condition re- <br />quirements accordingly. If the outcome is not known at the time <br />of final plat approval, then the dedicated monies will be held ''in <br />escrow" by the County pending the ultimate disposition of the <br />County's ordinance requirements and active condition requirements. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners approve <br />the offer to dedicate $8,200 to the park development fund at the <br />time of final plat approval for this phase of Sandpointe Subdivi- <br />sion, in lieu of requiring a public, river access easement, <br />subject to the following condition: <br />1. that if the lawsuit outcome is known -at the time of <br />final plat approval, the disposition of the water access <br />requirement and related active condition requirements at <br />the time of final plat approval shall apply to the <br />proposed dedication; if the lawsuit outcome is not <br />known at the time of final plat approval, then dedicated <br />funds shall be escrowed pending the final disposition of <br />the water access requirement and related active <br />condition requirements. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Scurlock, the Board unanimously (4-0), <br />Commissioner Bird being absent, approved the re- <br />quest by Sandpointe Unit II Subdivision to dedicate <br />funds in lieu of public access easement for <br />Sandpointe Unit II Subdivision (Riverside), as set <br />out in the above staff recommendation. <br />
