BOOK d [,,,, 89 <br />Section 10, Township 33 South, Range 39 East, Indian River County, Florida; <br />according to the Plat thereof as recorded in P1at.Book 11, Page 99, of the <br />Public Records of Indian River County, Florida. It is the petitioner's <br />intention to remain in compliance with Indian River County regulations by <br />releasing a five (5) foot portion of the utility and drainage easement, to meet <br />set -back -frau -easement requirements for swimming pools and decking. <br />The current zoning classification is RS -6, Single -Family Residential District. <br />The Land Use Designation is LD -2, Low -Density Residential, up to six (6) units <br />per acre. <br />ALTERNATIVES AND ANALYSIS: <br />Section 25(b)(6), Appendix A, Zoning, of the Code of Laws and Ordinances of <br />Indian River County, specifies that no pool shall be located closer than five <br />(5) feet to any easement, and.no pool deck shall encroach into any easement. <br />_ The request has been reviewed by the Southern Bell Telephone Company, Florida <br />Power & Light Company, Florida Cablevision Corporation, and the Indian River <br />County Utility Department, Engineering Division, and the Road & Bridge Divi- <br />sion. Based upon their reviews there will be no impact -on supplying utilities <br />and drainage to the subject property. <br />RECOMMENDATION: <br />Staff recommends to the Board, through the adoption of a resolution, the re- <br />lease of the westerly five (5) feet of the easterly twenty (20) foot utility <br />and drainage easement of Lot 26, Laurel Court Subdivision, as recorded in Plat <br />Book 11, Page 99, of the Public Records of Indian River County, Florida. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Scurlock, the Board unanimously (4-0), <br />Commissioner Bird being absent, adopted Resolution <br />89-52, abandoning certain easements on Lot 26, <br />Laurel Court Subdivision as shown in Plat Book 11, <br />Page 99, Public Records of Indian River County. <br />16 <br />
