TO: <br />The Board <br />of County <br />Commissioners <br />FROM: <br />Sharon P. <br />Brennan - <br />Assistant County Attorney <br />DATE: May 19, 1989 <br />SUBJECT: Hydrogeological Work at West Regional Wastewater <br />Treatment Plant <br />It has been determined by this office that the previous <br />award of this contract on March 21, 1989 was based on the <br />understanding that the requirements of the Consultant's <br />Competitive Negotiation Act (CCNA) were complied with prior <br />to submittal for the Board's approval. It has subsequently <br />been determined that the requirements of CCNA were not <br />adequately followed. <br />The Florida Department of Environmental Regulation Operating <br />Permit requires that the County perform a hydrogeological <br />analysis of the percolation ponds when the average daily <br />flows exceed 250,000 gallons per day. That figure was <br />reached in December, 1988. Because the analysis has not <br />been done, we are currently in violation of the conditions <br />for the permit and, therefore, there exists a valid public <br />emergency as certified by the County Administrator, whereby <br />an exception to the requirements of CCNA for the award of <br />this contract exists. <br />The contract, therefore, is being presented today for your <br />approval with the understanding that the previous award did <br />not meet with the requirements of CCNA, but that the delay <br />has caused a valid public emergency -whereby the County is <br />currently in violation of its operating permit for the West <br />Regional Wastewater Treatment Plant and, therefore, an <br />exception to the CCNA requirement for competitive <br />negotiation for the award of this contract exists. <br />Administrator Chandler informed the Board that when the <br />contract with Jammal & Associates was presented to the Commis- <br />sion on March 21st, it was for $5,575 and within the $6,000 <br />threshold of the Consultants Competitive Negotiations Act. There <br />is a possibility if the DER required additional information, it <br />could increase $500 to a total of $6,075. The Administrator <br />believed actually this is splitting hairs. <br />Commissioner Scurlock was concerned that we have been hold- <br />ing this up for quite some time for such a small amount, and <br />noted that he would like to have enough flexibility for the <br />Administrator to be able to use his judgment on things such as <br />this and not have to split hairs. <br />61 Boa 7 f'A.GE �� <br />c- e <br />6 AY 2 W8 <br />L_ <br />
