Pr - <br />JUS. 61999 <br />BOOK 76 F't41E1O 2. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, the Board unanimously approved <br />the Interlocal Agreement concerning the proration of <br />certain circuit -wide expenses of the Public Defender, <br />and authorized the Chairman's signature. <br />(FULLY EXECUTED COPY OF INTERLOCAL AGREEMENT IS ON FILE IN THE <br />OFFICE OF THE CLERK TO THE BOARD) <br />GAIN -TIME RESOLUTION <br />The Board reviewed the following memo dated 5/24/89: <br />TO: The Board of County Commissioners <br />FROM: Sharon P. Brennan - Assistant County Attorney <br />DATE: May 24, 1989 <br />SUBJECT: Gain -Time Resolution <br />This resolution is being presented today for the Board's <br />approval and adoption. If adopted, it will repeal the <br />previous resolution on this subject and will establish a <br />policy whereby certain factors, including jail capacity, <br />will be considered in determining whether discretionary <br />gain -time will be granted. The resolution has been reviewed <br />by the County Correctional Planning Committee which <br />recommends its approval to the Board of County <br />Commissioners. <br />Attorney Vitunac advised that he was asked by Commissioner <br />Eggert to explain the difference between this gain -time policy <br />and the old one. Besides cleaning up the grammar, simplifying <br />the organization, and the renumbering of the resolution, the only <br />change is some language included in several paragraphs which <br />allows the prison keeper to use as one factor the capacity of the <br />jail at the time he is ready to release prisoners. If the jail <br />has plenty of room, the Sheriff may not release the prisoners if <br />he so desires. If the prison is at capacity or over capacity, <br />then he uses the gain time list and uses it more frequently. The <br />idea is that if there is room at the jail, the Sheriff doesn't <br />have to let people out earlier than he has to. <br />76 <br />
