Vitunac, County Attorney <br />DATE: May 31, 1989 <br />RE: ADDITIONAL PARKING FOR MAIN LIBRARY <br />Some months ago the. Board of County Commissioners authorized <br />staff to propose the purchase of three lots immediately to <br />the east of the new main_library site and south of the main <br />Baptist Church. These lots are the site of the old <br />tabernacle, which is now surplus to the needs of the <br />church. The offering price was $175,000, and the appraised <br />value of the property was over $200,000. <br />As part of its master land use plan, the church is itself <br />trying to acquire three lots directly to the west of its <br />main church, and the owner would sell but for the capital <br />gains' implications of the sale to the church. I indicated <br />to the church that I believe the County would be willing to <br />use its eminent domain power to help acquire the three lots <br />to the west of the church and exchange these with attendant <br />boot for the three lots south of the church. This <br />"friendly" condemnation would allow the seller of the three <br />lots west of the church to rollover his capital gains <br />without declaring income tax. <br />If the Board approves of this method, 1 would respectfully <br />request authorization to proceed with the condemnation and <br />swap proposal. <br />Commissioner Eggert explained that the cost of acquiring the <br />3 lots may come in under $175,000. If not, she felt it would be <br />a wise move at this point to acquire Lot 8 also in order to <br />provide additional parking. She believed that would be a benefit <br />to all of us. <br />Commissioner Bird asked if there was a time factor here that <br />we have to move on this right now without waiting for our master <br />plan to be done to show us just what we do need in that area. <br />Administrator Chandler wasn't sure just what the church's <br />timing is on these properties. We are in the process of short <br />listing proposals on our master plan and will be bringing a <br />recommendation to the Board on July 11th. Among other things the <br />master plan is to look at our land needs in conjunction with the <br />87 <br />
