JUN <br />1 <br />1989 <br />eooK <br />V r, ru 78 <br />Director Davis <br />advised that staff has been working <br />with the <br />DOT for some time to try to get them to construct a northbound <br />left turn lane along U.S.1 at 99th St. This was included in a <br />resurfacing contract that the DOT has almost completed construc- <br />tion of, but for some reason, that left turn lane was omitted and <br />is not being constructed at this time by the DOT. <br />Commissioner Scurlock noted that his concern is that we <br />should have a consistent uniform process. He brought up the <br />example of Bernie Grail with one office building on Route 60 that <br />required a left turn lane, and while you could argue who <br />benefitted, Mr. Grail or Indian River Estates, he apparently did <br />not ask for a special assessment. Commissioner Scurlock believed <br />that in general when new development initiates an activity that <br />affects traffic, we tell them to go ahead and build the <br />improvement. <br />Commissioner Eggert believed that on U.S.1 north of Oslo <br />Road, there was some misunderstanding between the DOT and our <br />Community Development Department in regard to the improvement of <br />that intersection, and she wondered if there is any chance we are <br />into the same situation again up here. <br />Director Davis advised that the DOT has indicated they are <br />doing a median study of both Route 60 and U.S.I. and that this <br />site would be looked at within a year or so. However, it was <br />dropped out of this contract for economic reasons due to their <br />budget problems. <br />Community Development Director Keating felt that we do have a <br />consistent policy. Basically during TRC staff will tell the <br />applicant that if something is needed for a safety improvement <br />such as this, it is his responsibility. Then they outline the <br />funding alternatives he can pursue, one of which is the forced <br />assessment. <br />Director Davis further noted that any special assessment <br />project could certainly be precluded by a public hearing, and also <br />78 <br />
