77 rr11J l_�V <br />As a result of these considerations, a development plan has <br />been prepared that provides for the following actions: <br />1. dedication to Indian River County and the Town of <br />Orchid of 9' of right-of-way, from the center line <br />of the existing Jungle Trail roadbed, for that <br />portion of the road lying along an incorporated <br />boundary; <br />2. dedication to Indian River County and the Town of <br />Orchid of 18' of right-of-way for that portion of <br />Jungle Trail lying within the Town of Orchid; <br />3. an 11' conservation easement lying parallel to and <br />abutting the dedicated right-of-way, would be <br />granted to the Town of Orchid and Indian River <br />County, the conservation easement would preclude <br />the disturbance of any native vegetation and also <br />require approval by the Town Council of any <br />proposed activity within the easement; <br />4. running parallel to and abutting the conservation <br />easement, a 201buffer would be established as a <br />common element of the home owner's association. <br />The buffer would prohibit the removal of any <br />native vegetation, while encouraging the <br />establishment of new native plantings; <br />5. contiguous to the buffer, a 30' habitable building <br />setback will occur. Structures, such as: parking <br />garages, pools, fences, parking areas and utility <br />structures would be permitted, however, no <br />building that contains living space shall be <br />allowed. <br />All dedications would be provided via a recorded plat for <br />the Orchid Island Golf and Beach Club subject to approval by <br />the Town Council of the Town of Orchid, and -approval by the <br />Board of County Commissioners of the proposed re -alignment <br />of Jungle Trail <br />As previously mentioned, the re -alignment would also create <br />a parcel of land not appropriate for residential <br />development. The tract in question would be .located <br />immediately west of SR A -1-A, south of the entrance' road to <br />the Orchid Island Golf and Beach Club. The land would be in <br />an unusual configuration, however, the site's vegetation <br />warrants conservation measures regardless of the parcel's <br />shape. Therefore, in an effort to diminish any effects re- <br />alignment of the trail may have on the public, the developer <br />is willing to dedicate the 3.48 acre tract to the Town of <br />Orchid as a public conservation area. The parcel would <br />remain entirely undeveloped, however, provisions could be <br />made for the placement of a limited, emergency services <br />facility, subject to approval by the Town Council and the <br />Board of County Commissioners. <br />Assuming this proposal was acceptable to the Board, a total <br />of 10.55 acres of land would be dedicated to the public for <br />roadway and conservation land uses, while an additional 6.39 <br />acres would be reserved by the Orchid Island Golf and Beach <br />Club for the home owner's association as a buffer area <br />between the trail and future residential development. The <br />cumulative effect would be the dedication of 16.94 acres of <br />land for public use and scenic enjoyment, which, at current <br />real estate values is equivalent to $1,744,820. <br />50 <br />_ M <br />
