Heathe.".�/' <br />Code Enforcement Officer <br />DATE: June 7, 1989 <br />SUBJECT: Dempsey C. & Joycelyn Cain, Jr. Public Nuisance <br />Assessment for Abatement of Nuisance <br />RE: CV -89-06-230 <br />It is requested that the data herein be given formal consideration <br />by the Board of County Commissioners at their regular meeting of <br />June 27, 1989. <br />DESCRIPTION AND CONDITIONS: <br />On March 27, 1989, Code Enforcement staff sent a Notice of Public <br />Nuisance to Dempsey C. & Joycelyn A. Cain, Jr., concerning the <br />overgrown weeds. and accumulation of household trash, discarded <br />lawnmower parts, metal, and debris on their property at Lots 9 & <br />10, Block 1, Florida Ridge Subdivision. The respondents were <br />cited as maintaining their property in violation of Section <br />13-18(b)(1) of the County Code, which prohibits the accumulation <br />of junk, trash, and debris on any parcel of property. <br />The subject property was also posted as set forth in Section 13-23 <br />of the County Code, giving the respondents thirty (30) days to <br />abate the nuisance. <br />The junk, trash, and debris nuisance was not abated within the <br />required thirty (30) day time period. Therefore, in accordance <br />with Section 13-19(b), County Code, County Personnel (ie: Road & <br />Bridge Division) cleared the accumulation of junk, trash and <br />debris, with costs to be assessed against the property owners. <br />Section 13-21 of the. County Code requires that the cost of a <br />County nuisance abatement shall be calculated and reported to the <br />County Commissioners, who, by resolution, shall assess such costs <br />against the subject property. This matter is presented herein to <br />the Board for consideration to adopt said resolution. <br />ALTERNATIVES AND ANALYSIS: <br />Section 13-21(a), Public Nuisances, of the Code of Laws and <br />Ordinances of Indian River County specifically reads as follows: <br />6 <br />
