The purpose of this request is to secure the necessary land use <br />designation and zoning for a regional shopping center. The <br />applicant is proposing to construct a 747,000 square foot <br />commercial facility as part of a multi -use project that includes <br />64 residential units. The entire project is to be reviewed as a <br />Development of Regional Impact (DRI). Only that portion of the <br />project designated as commercial is covered in this request. <br />The procedures for reviewing Comprehensive Plan Amendments <br />associated with DRI's are the same as those which are normally <br />used; however, these amendments are exempt from the normal <br />amendment submittal timeframe. The concurrent Comprehensive <br />Plan/Rezoning/DRI review process is outlined in attachment 1. <br />The following steps occur upon completion of the DRI review by the <br />regional planning council. The Planning and Zoning Commission as <br />the Local Planning Agency conducts a public hearing to review the <br />request. The Commission has the option to recommend approval or <br />denial of the comprehensive plan amendment request to the Board of <br />County Commissioners. As is normally the case, the Planning and <br />Zoning Commission may approve or deny a rezoning request. In the <br />case of denial, only the land use amendment request goes on to the <br />Board, unless the denial to rezone is appealed. <br />Following the Planning and Zoning Commission action, the Board <br />County Commissioners (BCC) conducts two public hearings. The <br />first of these two hearings is for a preliminary decision on the <br />land use amendment and to consider the rezoning request. The <br />Board may transmit the request to the State Department of <br />Community Affairs (DCA) if the request warrants further <br />consideration. Once transmitted, the DCA conducts a 90 day review <br />of the request including comments from the Regional Planning <br />Council and neighboring local governments. Failure by the Board <br />of County Commissioners to transmit the request constitutes <br />denial. The second and final Board of County Commissioners public <br />hearing is conducted after the receipt of. comments from the DCA. <br />It is at this time that the Board takes final action to approve or <br />deny the request. <br />On January 26, 1989, the Planning and Zoning Commission voted 5-0 <br />to recommend the enlargement of the node from 10 acres to 92 <br />acres, and the rezoning of 82 acres from CL, Limited Commercial <br />and RM -6, Multi -Family Residential (up to 6 units/acre) to CG, <br />General Commercial for inclusion in the node. <br />On February 28, 1989, the Board of County Commissioners voted 5-0 <br />to transmit this request to the Florida Department of Community <br />Affairs (DCA) for review and comment. <br />On May 10, 1989, the DCA responded to this request with a <br />statement of no objections. <br />ALTERNATIVES & ANALYSIS <br />In this section, an analysis of the reasonableness of the appli- <br />cation will be presented. The analysis will include a descrip- <br />tion of the current and future land uses of the site and sur- <br />rounding areas, potential impacts on the transportation and <br />utility systems, and any significant adverse impacts on environ- <br />mental quality. <br />�I� r <br />JUL 111989 16 soar l F -,,u 2.,76 <br />
