-, _, r Q <br />UUL 11 'W9 buoP i I r,j.,,1'. 3� <br />Public Works Director Jim Davis advised that the Borchers' <br />attorney, Steve Henderson, sent a letter requesting a little <br />different wording in the permit which he feels would protect both <br />his client and the County regarding the fact that in the event <br />the County is prevented from utilizing the right-of-way for sewer <br />and water utility purposes described in this permit by reason of <br />future laws and regulations, then the County may terminate this <br />permit or require the relocation of the transmission line within <br />the boundaries of the right-of-way. Director Davis stated that <br />if the Board will give the County Attorney's office a little <br />flexibility in the wording, then staff's recommendation stands. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Eggert, the Board unanimously approved <br />staff's recommendation as set out in the above memo, <br />and authorized the County Attorney's office to make the <br />minor change in the wording of the permit as requested <br />by Attorney Henderson. <br />DEEDS ARE ON FILE INN THE OFFICE OF THE CLERK TO THE BOARD <br />61 <br />
