A <br />access and accommodate utilities services to parcels which at the <br />time of the swap, were either land -locked or served solely by <br />Jungle Trail. At the time of the right-of-way swap, staff was <br />concerned with how access and utilities services would be provided <br />to area land -locked parcels; thus, the subject right-of-way was <br />established. These land -locked parcels are now under a unified <br />ownership and the need for the subject right-of-way is greatly <br />diminished. <br />It is a matter of public record that the applicant is proceeding <br />to develop almost all of the area of the Town of Orchid, which <br />would encompass the area of concern. The applicant intends to <br />provide access and utilities to the area of concern through the <br />proposed development. It is the Town of Orchid's responsibility <br />to ensure that provisions for access and utilities are provided, <br />if the proposed development does not materialize and/car property <br />ownerships change. <br />Since this request was originally analyzed by staff, the <br />re -alignment of Jungle Trail has been conditionally approved. The <br />new Trail alignment has been moved further east where it inter- <br />sects with .the subject right-of-way. The staff wants to ensure <br />that the public has the right to access Jungle Trail via a S.R. <br />A.I.A. entry road, as is presently provided by the existing <br />subject right-of-way. The best way to achieve this would be for <br />the applicant to grant a 60' wide public access easement (which <br />overlays the Orchid development's entry road) from S.R. A.I.A. to <br />the new Jungle Trail portion. This easement would ensure public <br />access and needs to be granted prior to the recording of the <br />attached resolution. <br />As part of the abandonment application review, the Public Works <br />Director has indicated the need to minimize access points to S.R. <br />A.I.A.. This could be achieved with a limited access easement <br />provided along S.R. A.I.A., which would effectively limit dis- <br />ruption of the traffic flow on S.R. A.I.A. This would give the <br />development a curb cut on the east and west side of S.R. A.I.A. <br />and create only one major intersection for the Orchid development <br />(such as with John's Island) rather than a series of inter- <br />sections. This is desirable from the County's standpoint to <br />enhance traffic flow and from the development's standpoint in <br />trying to achieve a secure community. The applicant is agreeable <br />to establishing the limited access easement along S.R. A.I.A. <br />SUMMARY: <br />The subject right-of-way was established to service what were <br />landlocked parcels, and to provide for public access to Jungle <br />Trail from S.R. A.I.A. in the general area in which it is located. <br />Because of the assembled acreage covered by the Orchid develop- <br />ment, the concerns of servicing land -locked parcels has diminished <br />greatly. Public access from S.R. A.I.A. to the Trail can be <br />assured by the applicant by granting a public access easement from <br />S.R. A.I.A. along the Orchid development's proposed entrance road <br />whichcrosses the new Jungle Trail portion. In addition,. a <br />limited access easement can be established to assure limited <br />access along the development's S.R. A.I.A. frontage. <br />RECOMMENDATION: <br />Staff recommends that the County abandon its rights to the subject <br />right-of-way and that the Chairman of the Board of County Commis- <br />sioners be authorized to execute the attached resolution <br />(attachment #3), with the following conditions that: <br />1. Prior to the resolution being recorded, the applicant must <br />pay the cost of readvertising. <br />2. Prior to the resolution being recorded, the applicant shall <br />grant a limited access easement which limits the number of <br />42 <br />
