<br />It is requested that the data herein be given formal consideration
<br />by the Board of County Commissioners at their regular meeting of
<br />August 08, 1989.
<br />.:,....DESCRIPTION AND CONDITIONS:
<br />=:The County has been petitioned by Orchid Isle Associates Limited
<br />Partnership, through their attorney Bruce * Barkett, owners of the
<br />subject property, for the release of a ten (10) foot utility
<br />easement granted to the Florida Power & Light Company and the
<br />Southern Bell Telephone Company by Resolution #84-34, dated May
<br />'23, 1984. The subject easement is described as the north ten (10)
<br />.,-'.feet of the south thirty-eight (38) feet of that part of Govern-
<br />ment Lot 1, Section 23, Township 31 South, Range 39 East, lying
<br />west of the centerline of State Road A -I -A, Indian River County,
<br />Florida, and recorded in Official Record Book 0699, Pages 1017,
<br />1018, 1019, and 1020, of the Public Records of Indian River
<br />County, Florida.
<br />The subject property now lies, and is, within the corporate limits
<br />of the Town of Orchid, Florida, and it is the petitioners' inten-
<br />tion to utilize a large portion of the lands on which the easement
<br />lies for a residential development, at which time all the neces-
<br />sary dedications will be made to utility providers for service to
<br />the project.
<br />ALTERNATIVES AND ANALYSIS:
<br />The request has been reviewed by the Southern Bell Telephone
<br />Company, Florida Power & Light Company, Florida Cablevision
<br />Corporation, and the Indian River County Utility, Road & Bridge,
<br />and Public Works Departments. Based upon their review there was
<br />no objection to the release of the ten (10) foot utility easement;
<br />being the north ten (10) feet of the south thirty-eight (38) feet
<br />of that part of Government Lot 1, Section 23, Township 31 South,
<br />Range 39 East, lying west of State Road A -I -A, now lying and being
<br />in the Town of Orchid, Florida.
