Statutes and in the DOT Manual, and <br />what it does is protect the integrity of the arterial roadway <br />from side friction. It is a benefit to all the abutting property <br />owners that are connected to the marginal accesses. It is a <br />shared benefit, and he believed there is no question that Mr. <br />Hedin's business would benefit from this. <br />Commissioner Eggert asked if you can go a whole block and <br />not give access to U.S.I, and Director Davis advised that ideally <br />you would like to have marginal access roads with only two points <br />of ingress and egress. <br />Attorney O'Haire claimed that this is inverse condemnation <br />and noted that his firm has made a lot of money on that kind of <br />proceedings. <br />Attorney Vitunac pointed out that the County could adopt a <br />road program to buy some land from Mr. O'Haire's clients and some <br />others, put in a road, and assess the cost back to the people <br />benefited, which would be his client to some degree and the lots <br />to the south in a greater degree. The general public wouldn't <br />pay a cent for it, and you would have a public marginal access <br />road paid for by the people who benefited. This comes out to the <br />same thing that the county is doing there right now, and possibly <br />we should do that. <br />Attorney O'Haire pointed out that machinery is not in place <br />today, and his client has a right to say don't take my land <br />without compensation. <br />Director Davis continued to contend that this is more of a <br />site related improvement.
