Commissioner Scurlock wanted to have it on the record that <br />there is some grandfathering to a greater or lesser extent, <br />depending on who you are talking to, and Commissioner Eggert felt <br />that it is also important to state for the record what ways we <br />are trying to reduce the non -conformity. <br />Commissioner Scurlock stated for the record that the reasons <br />are to try and mitigate the damage to the dune and modify this in <br />a way that we move back from the construction setback. <br />Commissioner Bowman asked if they have explored the <br />possibility of moving this building back so that it does not <br />encroach at all, maybe at the loss of one or two parking spaces <br />or something like that, and Commissioner Scurlock advised that <br />Sea Oaks tried to do that, but they do not have enough room. <br />Commissioner Bird repeated that he is willing to give up the <br />height rather than give them the dune, but Commissioners Bowman <br />and Wheeler didn't want to set a precedent. <br />Commissioner Eggert also was concerned about setting a <br />precedent, but felt that there are a lot of things happening, and <br />if, as they say, there are very few approved site plans out there <br />that are phasing in this way, we are not going to see very much <br />of this. <br />Chairman Wheeler asked if anyone else wished to be heard in <br />this matter. There were none. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously approved <br />the request by Sea Oak Development Company, and <br />stated for the record that the ordinance does allow the <br />Board to mitigate any non -conformity, which is the <br />reason we are moving ahead with this trade-off between <br />the environmental versus the height and we recognize <br />it. <br />POOK `'AI;F 676 <br />11 <br />AUG 222 1989 <br />
