ORDINANCE NO. 89--24 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA AMENDING SECTION <br />24(b)(4); GENERAL PARKING STANDARDS, OF APPENDIX A OF THE CODE OF <br />LAWS AND ORDINANCES OF INDIAN RIVER COUNTY, FLORIDA, KNOWN AS THE <br />ZONING CODE: PROVIDING FOR THE MODIFICATION OF CERTAIN WHEELSTOP <br />AND CURBING REQUIREMENTS; AND PROVIDING FOR REPEAL OF CONFLICTING <br />PROVISIONS, CODIFICATION, SEVERABILITY, AND EFFECTIVE DATE. <br />NOW THEREFORE, be it ordained by the Board of County Commissioners <br />of Indian River County, Florida that: <br />SECTION 1 <br />Section 24(b)(4) be hereby amended as follows: <br />"(4) All parking spaces shall be equipped with tire stops <br />permanently affixed to the surface except when six-inch <br />curbing or the equivalent is installed, with the follow- <br />ing exceptions: <br />Upon request by a site plan <br />and communit develo ment d <br />stop/ --curbing requirement <br />upon a determination that: <br />a. the waiver would not <br />upon landscape or pe <br />valent <br />applicant, the public works <br />rectors may waive the wheel <br />Eor'certain parking spaces <br />allow vehicles to encroach <br />lestrian areas (such areas <br />wheelstops, curbing, or the <br />b. the waiver would not allow vehicles to abut or <br />head into" one another in an fashion other than <br />umper to bumper [any bumper to fender or side <br />parkingconfi urations shall require wheelsto s, <br />curbing, or the equivalent;_ <br />C. the waiver would not apply to any space "heading <br />into another space that requires a wheel stop, <br />nurbina. or other equivalent; and <br />d the waiver would not apply to spaces_ accessed from <br />driveways that serve as circulation driveways which <br />channel traffic around or through the site or <br />narking lot area. <br />e. the site lan arkin area and traffic circulation <br />design provide circulation driveways, as needed, to <br />adequately channelize traffic flow. <br />itions including but not limited to driveway curbing, signage <br />or pavement markings, or periodic placement of barriers or <br />eased protected landscaped areas that are designed to promote_ <br />traffic circulation may be attached to any waiver granted <br />SECTION 2 <br />REPEAL OF CONFLICTING PROVISIONS <br />All previous ordinances, resolutions, or motions of the Board <br />of County Commissioners of Indian River County, Florida which <br />conflict with the provisions of this ordinance are hereby repealed <br />to the extent of such conflict. All Special Acts of the legisla- <br />ture applying only to the unincorporated portion of Indian River <br />County and which conflict with the provisions of this ordinance <br />are hereby repealed to the extent of such conflict. <br />SECTION 3 <br />CODIFICATION <br />The provisions of this ordinance shall be incorporated into <br />the County Code and the word "ordinance" may be changed to <br />Coding: Words in WidWUhA type are deletions from existing <br />law.
