AUG) 2 1999 1� <br />BOOK 1 FAllL �� <br />Robert Keating, Director of Community Development, advised <br />that staff has talked to the people at Sea Oaks about our rec- <br />ommendation, which is to take another to k to accomplish the same <br />objective because there are conflicting objectives here. The <br />County wants to push them back, but the County also has <br />determined that it wants to keep the height at a minimum. If <br />that is the case, what we have suggested is that it would be a <br />policy decision made by a change in the ordinance. <br />Commissioner Scurlock asked if we have the ability under <br />Florida Statutes to make this modification without changing the <br />entire ordinance. <br />Attorney Vitunac advised that the Board could wait and see <br />if the DNR allows them to do it. If the DNR denies it, then they <br />can't do it. If the DNR lets them do it, then we could amend our <br />ordinance and allow them to build their revised plan. <br />Commissioner Eggert asked if she understood it correctly <br />that if we turn it down, Sea Oaks would have to go to the DNR <br />with the knowledge that we have turned it down. <br />Attorney Vitunac answered "no". We would be saying to go <br />ahead and build it, and that we are waiting for the DNR to turn <br />down their request for the modification to their original site <br />plan. <br />Commissioner Scurlock felt the net effect of that is that <br />the DNR could possibly turn them down and then they would file <br />for an administrative hearing, which takes another 90 days, after <br />which they would get a final decision and then begin the process <br />back here. He didn't believe it was the purpose of county <br />government to drag people through a long process. <br />Chairman Wheeler didn't want to amend the ordinance because <br />that would open it up to other people in the same situation. <br />Commissioner Bird felt that if he had to choose between <br />moving the building back further off the dune and not excavating <br />into the dune system or allowing more height, he would choose to <br />allow more height. <br />8 <br />M M M <br />
