Collins II - Assistant County Attorney <br />DATE: September 13, 1989 <br />SUBJECT: Turn Lane Along Barber Avenue at Medical Service <br />Subdivision/Indian River Memorial Hospital <br />On April 25, 1989 the Board of County Commissioners approved <br />a Developer's Agreement and budget amendment for the <br />construction of a left -turn lane along 37th Street (Barber <br />Avenue) at Indian River Memorial Hospital. In the agreement <br />the County was to formally bid the work. <br />On July 25, 1989 the Board approved the request of developer <br />Paul Koehler, that his contractor, Dennis L. Smith, Inc. <br />perform the work and that the County pay the contractor for <br />50% of the cost. The Board approved this request and waived <br />bidding in order to expedite the work. <br />The Developer's Agreement providing for the County to bid <br />the project cannot be amended without express written <br />consent and joinder of the Board of County Commissioners and <br />the developer. <br />RECOMMENDATION <br />Authorize the Chairman to execute the Amendment to the <br />Developer's Agreement along the lines previously authorized <br />by the Board on July 25, 1989. <br />Authorize the Chairman to sign the Contract with Dennis L. <br />Smith, Inc. for a 50% share of the work. <br />In discussion, it was -noted that this item was removed from <br />the Consent Agenda in error. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Scurlock, the Board unanimously authorized <br />the Chairman to execute the Amendment to the Developer's <br />>.Agreement previously approved July 25, 1989, and to <br />sign the contract with Dennis L.
