BOOK I F,°:GE 28 <br />The proposed wheelstop language contains the exact wording of the <br />T.C.R.P.C. recommendation plus an additional sentence added by <br />County staff. The additional sentence merely states that the <br />developer will have to either use curbing or its equivalent or <br />obtain a wheelstop waiver for any given parking space. T.C.R.P.C. <br />staff has indicated that it would not object to the proposed <br />language. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners approve <br />the proposed resolution, authorizing the Chairman to sign the <br />resolution amending the existing Harbor Town Center mall develop- <br />ment order (Resolution No. 89-31A). <br />Chief Planner Boling informed the Board that Attorney Steve <br />Henderson, representing Shopco, contacted him in regard to the <br />paragraph which was inadvertently left out and has recommended <br />some word changes, with which staff has no problem. In Paragraph <br />5 as proposed in the backup packet, where reference is made to <br />what happens in the event that the Mall Development is <br />terminated, the term "development approval" is used three times, <br />and the applicant would like to change that wording and replace <br />it with "development.order." Also, at the end of -that paragraph, <br />they would like to add a sentence to state that "The County in <br />its discretion may waive this provision." Staff has no problem <br />with this. <br />The Chairman asked if anyone present wished to be heard. <br />There were none, and he thereupon closed the public hearing. <br />Commissioner Eggert asked if this finalizes the Development <br />Order, and Planner Boling confirmed that it does, and we now will <br />transmit it to the Treasure Coast Regional Planning Council. <br />ON MOTION by Commissioner Eggert, SECONDED by Com- <br />missioner Bowman, the Board unanimously (3-0) adopted <br />Resolution 89-128 amending the Development Order <br />approved for the Harbor Town Center Mall DRI, with <br />the wording as amended above. <br />25 <br />
