EXCHANGE OF R/W DEEDS BETWEEN BAILEY & BAILEY, GENERAL <br />PARTNERSHIP & COUNTY - (74TH AVE. R/W) <br />The Board reviewed the following memo: <br />TO: James E. Davis, P.E. <br />Public Works Directo <br />SUBJECT: Exchange of Right -of -Way Deeds Between <br />Bailey & Bailey, General Partnership <br />and Indian River County <br />REFERENCED LETTER: Steve L. Henderson to Jim Davis <br />dated September 26, 1989 <br />DATE: October 2, 1989 <br />DESCRIPTION AND CONDITIONS <br />In researching the adequacy of the 74th Avenue right-of-way south <br />of Oslo Road, staff and Attorney Steve Henderson have discovered <br />a misalignment of a 30' wide section of the right-of-way (Sketch <br />attached). To correct the misalignment, the abutting property <br />owners, Bailey and Bailey, A General Partnership, have agreed to <br />exchange deeds with the County. <br />ALTERNATIVES AND ANALYSIS <br />The correction of the alignment is mutually beneficial to both <br />parties. To correct past errors, the exchange of deeds is the <br />only alternative. <br />RECOMMENDATION AND FUNDING <br />It is recommended that the Board Chairman and Clerk be authorized <br />to execute the attached deed in exchange for the County receiving <br />a deed for the proper alignment of 74th Avenue. <br />OCT 1Q 19 <br />ON MOTION by Commissioner Bird, SECONDED by Commis- <br />sioner Scurlock, the Board unanimously authorized <br />the Chairman to execute deed as described above. <br />9 <br />36 <br />800K <br />
