McC <br />Staff Plann <br />r nt Development <br />DATE: September 27, 1989 <br />SUBJECT: ROSELAND VOLUNTEER FIRE DEPARTMENT REQUEST FOR THE <br />ABANDONMENT OF 80th AVENUE <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of October 24, 1989. <br />LOCATION AND DESCRIPTION: <br />John F. Morrison, on behalf of the Roseland Volunteer Fire Depart- <br />ment, has submitted a petition for the abandonment of a portion of <br />80th Avenue between 129th Street and 129th -Court. Per guidelines <br />established by the Board of County Commissioners,the petition was <br />reviewed by all County divisions and utility providers having <br />y= -jurisdiction within the right-of-way. All reviewing agencies have <br />recommended approval of the abandonment with Utilities and Public <br />Works recommending that approval be granted with conditions that <br />certain easements be retained. <br />fl ANALYSIS: <br />Presently, the 80th Avenue right-of-way is a paper street and <br />unimproved. The applicant has not indicated any future use of the <br />right-of-way, but the abandoned right-of-way could be used for <br />expansion of Fire Department facilities. Even with an easement <br />being retained over the entire right-of-way, the applicant would <br />benefit since the easement could be counted as required setback <br />area, thus increasing the lot's buildable area. <br />The Utilities Department has recommended that an easement be <br />retained for possible future use with the expansion of the North <br />County Regional Wastewater collection system. Public Works has <br />recommended that the entre right-of-way be retained as a drainage <br />easement because the St. John's Water Management District will <br />require additional stormwater retention when area roads are paved. <br />Given the property ownership characteristics of the area, there is <br />a potential for the interior lots of block 28 to be land -locked if <br />this right-of-way is abandoned. Currently lots 1, 2, 3, 8, 9, 10 <br />are owned by the Fire Department,and lots 4, 5, 6, 7 are owned by <br />another party. The owners will both need to execute unity title <br />forms for their respective lots prior to the abandonment being <br />recorded to ensure frontage (on other existing roads) for these <br />parcels. The County staff, as of yet, has been unable to contact <br />the owner of the adjacent lots to see if he would consent to <br />executing a unity of title. The resolution should not be executed <br />unless the adjacent lot owner executes the unity of title form. <br />18 <br />
