GE <br />V <br />Pj4 <br />Commissioner Scurlock wished to be sure that when we draw up <br />the vacation, we make sure the language regarding retainment of a <br />drainage and utilities easement is broad enough to be inclusive <br />of all type of activities the County would normally be involved <br />with in the R/W. <br />Vice Chairman Eggert asked if anyone present wished to be <br />heard. There were none, and she thereupon closed the public <br />hearing. <br />ON MOTION by Commissioner Scurlock, SECONDED by Com- <br />missioner Bowman, Commissioner Bird and Chairman <br />Wheeler being absent, the Board unanimously (3-0) <br />adopted Resolution 89-136 providing for the abandon- <br />ment of 80th Avenue between 129th Court and 129th <br />Street as requested by the Roseland Volunteer Fire <br />Department. <br />RESOLUTION NO. 89- 136 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING, <br />ABANDONMENT, AND VACATION OF 80TH AVENUE BETWEEN 129th <br />COURT AND 129TH STREET SAID LANDS LYING IN INDIAN RIVER, <br />COUNTY. <br />WHEREAS, on July 19, 1989 the County received a duly executed <br />and documented petition from John F. Morrison agent for the <br />Volunteer Fire Department of Roseland Florida, requesting the <br />County to close, vacate, abandon and disclaim any right, title and <br />interest of the County and the public in and to 80th Avenue <br />between 129th Court and 129th Street, said lands lying in Indian <br />River County, Florida. <br />WHEREAS, in accordance with Florida Statutes §336.10, notice <br />of a public hearing to consider said petition has been duly <br />published; and <br />WHEREAS, after consideration of the petition, supporting <br />documents, staff investigation and report, and testimony of all <br />those interested and present, the Board finds that said <br />right-of-way is not a state of federal highway, nor located within <br />any municipality, nor is said right-of-way necessary for continu- <br />ity of the County's street and thoroughfare network, nor access to <br />any given private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS- <br />SIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1.
