TO: Board of County Commissioners <br />FROM: Charles P. Vitunac, County Attorney <br />DATE: October 20, 1989 <br />RE: SPECIAL LEGAL DEFENSE FUND ASSESSMENT <br />FLORIDA ASSOCIATION OF COUNTIES <br />The attached letter from the Florida Association of Counties <br />is requesting that Indian River County, through the County <br />Attorney's Office, donate $800 to the Special Legal Defense <br />Fund for representation of all counties in matters of <br />state-wide Importance. Since this matter was not <br />anticipated it was not budgeted in my budget, and I am <br />requesting direction from the Board on whether to <br />participate with the Florida Association of Counties or not. <br />Thank you very much. <br />Commissioner Scurlock felt this request should be denied as <br />he believed the Association is aware of the budget year. <br />Attorney Vitunac noted that this is the group that <br />represents all counties' interests at the state level. They have <br />no state funds for this purpose other than what the counties give <br />them. <br />Commissioner Scurlock commented that actually small counties <br />often have different interests than the larger ones and sometimes <br />are at cross purposes with the larger ones. He, therefore, would <br />rather see this funded on the basis of us wishing to participate <br />for that particular item. <br />Commissioner Bird noted that he hates to be a member of the <br />Association and not participate unless we have strong reasons. <br />He asked Attorney Vitunac how he felt about this. <br />Attorney Vitunac advised that he could write a letter saying <br />that we will consider this next year at budget time as he did <br />feel the Association should be aware of budget constraints. <br />Commissioner Scurlock continued to stress that there are <br />significant differences between the large and small counties and <br />expressed concern that we will be funding an action that may not <br />be in our interest.
