RESOLUTION NO. 89-141 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA REGARDING ISLANDS IN THE ST. <br />SEBASTIAN RIVER. <br />WHEREAS, the State of Florida is investigating <br />priority purchase of lands around the St. Sebastian River <br />under the CARL Program for the purpose of establishing a <br />manatee sanctuary; and <br />WHEREAS, the restoration and preservation of the <br />St. Sebastian River and Its tributaries to their natural <br />state, including without limitation, the preservation of <br />islands would further the manatee preservation objective; <br />and <br />WHEREAS, on October 5, 1989 Standish F. Crippen, <br />Jr. filed Case No. 89 -0631 -CA -13 in the Circuit Court in and <br />for the Nineteenth Judicial Circuit in Indian River County <br />seeking to quiet title to four islands lying in the channel <br />40 <br />of the St. Sebastian River; and <br />WHEREAS, based upon a. title report issued by <br />Commercial Title Services, Inc. of Vero Beach on August 16, <br />1985, substantial doubt exists as to whether Standish F. <br />Crippen, Jr. has a legitimate claim to said islands; and <br />WHEREAS, pursuant to quit -claim deeds in 1969 from <br />adjoining upland owners, the Florida Audubon Society has an <br />interest in said islands; and <br />WHEREAS, said islands lie within the jurisdiction <br />of both Indian River and Brevard Counties and each county is <br />interested in said islands; and <br />'WHEREAS, said islands should be preserved for the <br />public use and benefit; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that <br />the State of Florida, through the Department of Natural <br />Resources, is asked to intervene in Case No. 89 -0631 -CA -13 <br />in the Nineteenth Judicial Circuit in and for Indian River <br />77 <br />NOV `‘ X989 <br />BOOK 78 rA. jJ <br />
