the ability within his agreement with the tenants to pass the <br />charges through to them. We couldn't differentiate between which <br />tenants can get the pass through and which can't, because it <br />really isn't our business to be involved in the leases. <br />Commissioner Bowman asked how the impact fees would be <br />applied to the current vacant sites and undeveloped sites, and <br />Director Pinto explained that the park owner will have to pay <br />those impact fees at the time a unit is put on the lot. The park <br />owner owns the lot and rents the sites to the tenants who own <br />mobile homes or RVs. <br />Director Pinto noted that there are two treatment plants <br />within the park at the present time, and had to admit that for <br />the type of plants they are, the park has done a fairly good job <br />in upkeep. However, the plants are old and the percolation ponds <br />are really within the lake system of the park and could be a <br />future problem, if not an existing problem. He felt this is a <br />good agreement, and recommended approval. <br />There being no further questions of staff, Chairman Wheeler <br />opened the Public Hearing, and asked if anyone wished to be heard <br />in this matter. <br />Richard Negley, regional manager of Aspen Whispering Palms <br />Limited Partnership, wished to clarify a couple of things that <br />Mr. Pin -to has referenced. First, there are both mobile home <br />sites and RV sites in the park. The RV sites, through the <br />dialogue they had with the County, were set at a lesser rate than <br />the mobile home sites. Secondly, the owners have no doubt that <br />the impact fees can be passed through to the owners of the mobile <br />homes, and he wished to make that fact clear to the people who <br />are in attendance this morning who own mobile homes in Whispering <br />Palm Mobile Village. It is the opinion of the park owners' <br />attorneys and the opinion of the Department of Business <br />Regulation that the impact fees can be passed through to the <br />owners of those mobile homes. <br />NN O V 689 <br />13 <br />�P , <br />BOOK!
