(4, <br />Eric John, resident of Whispering Palm, disagreed with <br />Director Pinto about this being a good agreement, because one of <br />the whereas clauses states that the sites have to pay the money <br />for the impact fee. He was sure that everyone understands that <br />sites do not have any money; the owner of the park has the money, <br />and he is the one that has to pay. Mr. John suggested that the <br />language was purposely set up to mislead some of the people. He <br />didn't think it was a question of misunderstanding, as he felt <br />the residents understand very well that the whole issue here is <br />who is going to pay the impact fees. When the language in the <br />agreement states that the site pays, it befuddles the issue. <br />Further in the agreement, it says that the park and the County <br />agree that the owner has to pay. In the 4th paragraph it says <br />that the park must pay direct costs, impact, and hookup fees, but <br />later in the agreement, it turns around and says that those <br />people who are renting are going to have to pay. Mr. John didn't <br />feel that made any sense at all, because it has to be either one <br />way or another. He suggested that if the County gets involved, <br />it should not obligate the people who are renting. If someone <br />should sell his mobile home one year after this is in force, he <br />would have to pay the entire impact fee at that time. On the <br />other hand, these impact fees can be stretched out over a 12 year <br />period, and if someone should sell his mobile home then, he would <br />have had the use of the sewer for all those years. He also <br />wished to point out to the Commission that there are a lot of <br />mobile homes for sale in that park and the reason for that is <br />that a lot of people are leery of what is going to happen with <br />that park. Mr. John just did not believe that the County and the <br />park owners can negotiate for a third party (the tenants) and <br />obligate them to pay. He pointed out that in a case of somebody <br />selling a single-family home, the impact fee would not be charged <br />to the renter, it would be charged to the owner of that home. <br />Why should it be any different in a mobile home park? <br />16 <br />
