between the County and the park owner. Let the park owner talk <br />to the tenants about how he wants to collect the money for the <br />impact fee. <br />Commissioner Bird said that we can do that, but the bottom <br />line effect could be that if we send him a bill to him for all <br />the units tomorrow, the owner may send a bill to the residents <br />the very next day for immediate payment of their impact fees. <br />Director Pinto didn't believe we are placing a liability on <br />the people from the county, but Mr. John disagreed. <br />Attorney Vitunac stated that we absolutely are not, and <br />asked Mr. John to read any sentence or paragraph in the agreement <br />to that effect. <br />Mr. John read from Item #5: " in accordance with <br />legally enacted ordinances of Indian River County, Florida, shall <br />be due and payable". Mr. John felt that statement makes Indian <br />River County responsible. <br />Commissioner Eggert pointed out that the only alternative to <br />that is to have all the fees paid now. This agreement allows a <br />delayed payment until most of the people who are in there now <br />sell their units. <br />Mr. John urged the Board to delete any language in the <br />agreement that says the people will pay. He didn't think that we <br />are going to resolve this today, and suggested that the <br />Commissioners read over the agreement and note the loopholes such <br />as the park owner getting a credit for the water/sewer that is <br />being supplied. <br />Director Pinto reiterated that if we were to eliminate the <br />portion that says that this money would be collected at the <br />transfer of the title, we would not be helping the people that <br />are there. We would be damaging their ability to pay this at a <br />more convenient time. Some people will live there all their <br />lives and will never have to pay until the unit is sold or their <br />heirs will have to pay at the time the title is transferred. <br />Director Pinto recommended that the agreement be approved as <br />NOV 14 `0$9 <br />21 <br />BOOK 10 FacE 377 <br />
