Mr. Ramsey expressed his <br />appreciation for the Commission's response to the public's <br />questions on this document. <br />Commissioner Eggert understood that this agreement states <br />that the park owner is obligated to pay these impact fees for the <br />benefit of each site and that the sale of a unit triggers his <br />requirement to pay, and he gets the money to pay. In other <br />words, this is not triggering the tenant to pay, but is <br />triggering the owner to pay. <br />Attorney Vitunac stated that is correct. The owner has 3 <br />choices. He may pay in cash; he may sign each site up for a <br />10 -year payment plan; or he may do nothing until the unit turns <br />over and then he owes the whole thing at once. <br />Commissioner Bird asked about the RV sites, and Attorney <br />Vitunac explained that the options would be either cash or a <br />10 -year payment plan, because there isn't going to be anything to <br />trigger a sale because there are no units on there to sell. <br />Commissioner Eggert asked what happens if an owner of a <br />mobile home sold his unit and just moved away. Would the owners <br />of the park be obligated to pay that impact fee whether or not <br />they have gotten any money from the owner of the mobile home at <br />the time of the sale? <br />Attorney Vitunac confirmed that would be the case, but noted <br />that the word "tenant" is not used in the agreement. <br />Commissioner Eggert pointed out that the agreement does <br />refer to the occupants and taking them on as customers. <br />Attorney Vitunac suggested that if it would make the Board <br />feel better, we can add a paragraph at the end of this agreement <br />that says by signing this agreement the County in no way makes a <br />decision on whether the park owner or the tenants have to pay any <br />impact fees. <br />Commissioner Eggert felt that we have made a decision and <br />that decision is that the owner has to pay, but how he gets that <br />money is his business. <br />NOV IL1989 <br />23 <br />
