3) The addition of Item #10: "Whether any obligation on the <br />part of the Park can be passed to the park tenants or not is <br />a matter between the Park and the park tenants." <br />Chairman Wheeler asked what would be the harm in adding <br />that there is no intent by the County in this agreement to <br />indicate that the tenants are responsible for the impact fee, <br />because there is no intent. We are not going to go against the <br />tenants; there is absolutely no intent. <br />Attorney Vitunac pointed out that it doesn't give them any <br />real protection, and it would make it Tess likely that Mr. <br />Negley's people will sign the contract, and we have been trying <br />to get them to sign for two years. <br />Commissioner Eggert didn't feel it was necessary, and might <br />even be a hindrance. <br />Attorney Vitunac noted that Commissioner Bird already has <br />stated that the Minutes are available as to the intent here <br />today. <br />Chairman Wheeler suggested that during the time we are <br />renegotiating this with the park owners, the residents get with <br />Director Pinto and set up a meeting with the residents of the <br />park to make this clear so that, hopefully, everyone will feel <br />more comfortable with it. <br />There being no others who wished to be heard, the Chairman <br />closed the Public Hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously (4-0, <br />Commissioner Scurlock being absent), approved the <br />Agreement Between Indian River County and Aspen - <br />Whispering Palms Limited Partnership Re: Wastewater <br />Service to Whispering Palm Mobile Village, with the <br />three amendments as set out in the above discussion. <br />AGREEMENT WILL BE PLACED ON FILE WHEN FULLY EXECUTED AND RECEIVED <br />NOV i 4 19B9 <br />31 <br />BOOK.oBOOK./ o pa, L 387 <br />
