Neither of these types of mining operations <br />affect the ground water level and would not affect the available <br />supply of well water for surrounding single family residences. <br />Based upon the fact that "non -de -watering" types of operations are <br />viable and could have no adverse effect on groundwater quantity or <br />quality, the applicant is proposing that the ordinance be changed <br />to permit these types of mining operations within 1000' of a <br />platted subdivision having no public water service. <br />The staff has researched such a proposal and has concluded that <br />the intent of the existing criterion, to help protect well water <br />supplies from de -watering impacts, could be satisfied by means <br />other than the 1,000' separation requirement. The staff has <br />proposed to revise the criterion to read as follows: <br />• <br />"6. The site must not be located within one thousand (1,000) <br />feet of any platted subdivision that is not serviced by <br />public water. However, this provision can be waived by <br />the approving body provided that: <br />a. <br />b. <br />c. <br />`yy4'RECOMMENDATION: <br />',Based on the analysis performed, staff recommends that the Board <br />,of County Commissioners approve the Ordinance amendment proposed <br />=by staff. <br />the applicant provide a sworn statement as to the <br />method of mining which states that no de -watering <br />will occur, (whether drained off-site or recir- <br />culated on site); <br />the applicant provide information locating all <br />wells within 1,000' of the project site as defined <br />in the ordinance; and <br />the applicant provide a certified statement by a <br />groundwater hydrologist stating that the proposed <br />mine will not affect groundwater quality or quanti- <br />ty, referencing the well location information <br />required above. <br />Chief Planner Boling pointed out that this is an ordinance <br />text amendment which would apply to the entire county, and it <br />deals with one of the setbacks in our current regulations that <br />affect mining operations. He noted that for any mining operation <br />there are two setbacks that are key and referred to the following <br />graph: <br />14 <br />
