X989 <br />ROOK 78 D.r,E 47j <br />Commissioner Bowman felt that they simply shouldn't have <br />been allowed to excavate down to the water table. <br />Director Keating believed these are good points. He agreed <br />that basically there is less protection in a development such as <br />Lake in the Woods, for instance, than there is in something that <br />is strictly a mining activity, and staff can look at this when <br />re -doing the Land Development regulations. <br />Commissioner Scurlock felt we need to look into this, <br />especially as we start seeing in -filling of areas between <br />existing neighborhoods. <br />Commissioner Bowman stressed her belief that you could <br />reduce the amount of fill you require if you just used it for <br />your roadways and put your buildings up on pilings. <br />The Chairman asked if anyone present wished to be heard. <br />Randy Mosby of Mosby and Associates, Inc., came before the <br />Board representing the applicant. He wished to make the point <br />that the ordinance was set up originally to apply to the dry <br />mining process, which type mining does have an effect on <br />neighboring wells. Mr. Mosby further pointed out that while St. <br />John's River Water Management District does require consumptive <br />use permits on a dry mining operation of any size to insure there <br />is nodrawdown on adjacent wells, they do not require consumptive <br />use permits on the wet mining process for operations of less than <br />12 acres. He stressed that why they are here today relates to a <br />strictly technical question, and they are just requesting an <br />amendment to the ordinance to allow wet mining operations closer <br />than 1,000' to subdivisions that do not have public water, with <br />the conditions outlined in staff's memo. <br />Planner Boling confirmed that staff is recommending approval <br />of the requested waiver provision with the 3 conditions suggested <br />in staff's memo, and Mr. Mosby believed that the P&Z concurred <br />with this also. <br />Robert Musante. 7925 126th St., Vice President of the <br />Roseland Property Association, came before the Board speaking for <br />16 <br />
