Commissioner Bird believed Mr. Smith has raised a question, <br />at least in his mind, as to whether or not we should allow a <br />mining operation closer than 1,000' from a platted subdivision <br />regardless of the dewatering aspect. <br />Mr. Smith continued to stress that if the subdivision is on <br />public water, they can get much closer, but Commissioner Scurlock <br />felt that Mr. Smith has pointed out something that raises the <br />question of whether these operations should be allowed in a <br />residential area at all. <br />Mr. Smith again emphasized that they still have to meet all <br />the other regulations. <br />Chairman Wheeler believed Mr. Smith's request is legitimate <br />based on the way the ordinance is written, but what he is <br />hearing, that he agrees with, is that possibly we shouldn't allow <br />mining at all within 1,000' of a subdivision and that possibly we <br />also should change the ordinance to require greater setbacks from <br />residential areas. <br />Commissioner Bird noted that the issue before us today that <br />these people have made their petition under is based on existing <br />rules, and he wished to know what action we need to take today <br />with what is before us to keep the 1,000' buffer - would that be <br />to deny their request? <br />Commissioner Bowman agreed that would be the action we <br />should take and suggested that we also ask that the ordinance be <br />amended to address the other problems raised today. <br />Commissioner Scurlock brought up the point that there are a <br />lot of places that are designated Agricultural/ on the map, and <br />while we tend to think of Agricultural in terms of large areas <br />lying out to the west of the county, there are a lot of little <br />pockets of Agricultural all over the county. <br />Commissioner Bird stated that he did not want to do anything <br />today to change the rules of the game as they exist, but he also <br />was not prepared to take any action today that would have the <br />N O V 9 8 1989 <br />21 <br />BOOK 78 ' ,; 478 <br />
