Keating, AICP RMK <br />Community Development Director <br />DATE: November 27, 1989 <br />SUBJECT: LAND DEVELOPMENT REGULATIONS <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of December 5, 1989. <br />DESCRIPTION & CONDITIONS: <br />According to the Local Government Comprehensive Planning and Land <br />,Development Regulation Act of 1985, every local government in the <br />(state must adopt revised land development regulations within one <br />;;:,:year of its comprehensive plan submittal date. For Indian River <br />'='County,"..the applicable date for land development regulation <br />adoption is September 1, 1990. <br />'Even though the state Departmentof _ Commun <br />_ tyAAffaizs.s <br />completed its : review of the -county' s draft comptei eiiis <br />the staff has already started work on the revised land .develop -W <br />'ment regulations. So far, that work has involved identifying <br />;comprehensive plan policies requiring land development regulation_ <br />:modification, inventorying existing land development regulations <br />:`'for content, analyzing existing regulations for inconsistencies, <br />developing a proposed format for the revised regulations, and <br />,. preparing a work program and schedule. <br />At this time the staff needs direction from the Board of County <br />Commissioners regarding several land development regulation <br />preparation issues. These issues are: format, consultants, and <br />public participation. Each will be discussed below in the <br />alternatives and analysis section. <br />ALTERNATIVES & ANALYSIS: <br />As the implementing mechanism for the comprehensive plan, the <br />county's land development regulations are an integral part of the <br />planning process. According to other local government represen- <br />tatives, the land development regulation process may be even more <br />intensive than the comprehensive plan development process. For <br />that reason, it is necessary to make some initial decisions at <br />this time. <br />- Format <br />The county's land development regulations are part of its code of <br />laws and ordinances. At.this time, however, not all of its land <br />development .regulations are consolidated within the code book. <br />While the principal development regulations, the zoning code and <br />subdivision ordinance, are appendix A and B, respectively of the <br />code of laws and ordinances, other land development regulAtions, <br />such as the landscaping ordinance, the stormwater management <br />ordinance, the tree protection ordinance, and others, are scat- <br />tered throughout the code book. One objective of revising the <br />county's land development regulations is to consolidate all of <br />the county's development related ordinances, making them easier <br />to use by both the staff and the general public. <br />To facilitate this, the planning staff has been working with the <br />county attorney's office. While the county attorney's office has <br />taken the lead in reformatting the entire code of laws and <br />DEC <br />21 <br />
